 | PERM is the new alien labor certification process, and is effective for
all applications filed on or after March 28, 2005

 | PERM "automates" much of the labor certification process

 | Employers will recruit for a position at least 30 days (and no more than
six months) BEFORE a PERM application can be filed

 | Recruitment includes at least two Sunday newspaper ads in the most
appropriate newspaper in the employment area, job postings, a job order with
America's Job Bank.

 | For positions normally requiring a degree, a professional journal ad may
be substituted for one of the Sunday ads, and three additional recruitment
steps are required from a specified list.

 | PERM applications may be filed electronically or by mail, and can be
reviewed normally in 30 to 60 days (according to the Department of Labor).

 | Recruitment documentation must be maintained by the employer for five
years, but is not filed with the PERM application. It may be requested
by the Department of Labor.

 | The PERM application will be approved or denied - or may be subject to
audit.
|
 | Audits may be triggered by the type of information supplied by the
employer on the PERM application.
|
 | Audits will also be triggered through random selection.
|
 | PERM recruitment will normally be self supervised. Employers found
to have violated their obligations regarding documentation or attestation
will be subjected to a requirement of "supervised recruitment." |
